These General Terms and Conditions (“Terms and Conditions”), which shall be governed by French law, govern the use of the Cook n'Share Website. By registering on the Website in accordance with the terms and conditions set out below, you expressly and unreservedly accept these Terms and Conditions. Any amendment of the Terms and Conditions will be posted on the Website.

1 Presentation of the Cook n'Share Website

Cook n'Share is a platform sponsored by Pyrex which enables its members to create, publish and share their own recipes and to search, view, save and comment on other members' recipes. Cook n'Share is the first European Internet platform that aims to unite people from across Europe who wish to share their passion for cooking.

2 Your intellectual property rights

By registering on Cook n'Share and posting a recipe on our Website, you waive all rights to your recipe in favour of Pyrex, which shall reserve the right to use all or any part of the recipe in its publications.
In return, Pyrex agrees to mention the recipe author's name.
Cook n'Share shall acquire the right to reproduce recipes posted by its members.

As soon as you make your recipes available to other users (individually or in groups), you agree to these users being able to view your recipes on the Cook n'Share Website and other electronic communication media (in particular mobile phones), free of charge and for personal use only, for as long as your recipes are posted on the Website. If you wish to use the recipes posted by another member, in particular for commercial purposes, you must first obtain the necessary authorisations from that member. In addition, for as long as your recipes are posted on our Website, you authorise us to reproduce/display your recipes and, if necessary, to adapt the format as required, strictly within the scope of making the Cook n'Share Website available on the Internet or on other electronic communication media. You are hereby informed that, considering the intrinsic characteristics of the Internet, any information posted on the Website, in particular your recipes, shall not be protected against potential misuse and/or hacking, and we shall not be liable for any such acts. You must, where applicable, take the appropriate measures in order to protect information posted by you.

3 Our intellectual property

The Cook n'Share Website belongs exclusively to us. Generally, we grant our members a personal, non-exclusive and non-assignable right to access and use the Website free of charge. Members shall not be granted any other rights without our prior written consent.

4 Our liability as host

We are not legally bound by any obligation to monitor recipes posted or stored on the Cook n'Share Website. As Website host, we are solely obliged to ensure that no lawful content is posted on our Website, to protect your personal data – which shall be covered by professional secrecy and processed in accordance with data protection laws – and to remove any unlawful content as soon as we become aware thereof.

5 Your responsibility as user

As provider of the content of the Cookn'Share Website (recipes, photos, videos or comments posted by you), you must comply with the laws and regulations in force. Accordingly, you must ensure that the storage and circulation of such content on the Cook n'Share Website does not breach the intellectual property rights of a third party (in particular, rights to magazines, websites and cookery books not created by you or for which you have not received the requisite authorisation from the holders of such rights), that it does not cause harm to individuals or adversely affect their personal life (in particular through libel, insults, slander, etc.) and that it does constitute a breach of public decency and public morality (in particular, an apology for crimes against humanity, incitement to racial hatred, child pornography, etc.). Otherwise, the content will be removed in accordance with paragraph 4 and/or your account will be deactivated without formality. In addition, you shall personally incur the criminal sanctions relating specifically to the content at issue (imprisonment and fine) and you may be ordered to pay damages. Considering the fact that the Cook n'Share Website is available throughout the European Community and out of respect for the sensitivity of all users of our Website, users must ensure that their recipes, videos, photos, comments, etc. posted on our Website are ethical. In particular, users must refrain from posting any violent or pornographic content on our Website.

6 Registration and access

In order to enjoy the benefits of the Cook n'Share Website, you must set up an account using the designated online form. You may amend the personal data you provide to us at any time. You may access your account using your username and password, which you must not disclose to others. Once you have registered, you may use the Website for an unlimited term. We reserve the right to cancel your membership at any time via the “My kitchen” web page. If you fail to comply with your aforementioned obligations, access to your personal web page may be temporarily or definitively deactivated with immediate effect and without notice, without prejudice to our other rights.

7 Availability of the Cook n'Share Website

In principle, the Cook n'Share Website is available 24 hours a day 7 days a week, except in the event of a scheduled or unscheduled interruption for maintenance purposes or in the event of force majeure. As we are bound by a best endeavours obligation, we shall not be liable for any harm whatsoever sustained on account of the Website being unavailable.

8 Evidence, safekeeping and storage

The computer files stored in our information systems in accordance with the applicable security regulations shall constitute evidence of the transmission of e-mails and registration forms and the posting of comments, recipes and photos. Registration forms shall be saved on a reliable and durable medium in accordance with the laws in force. In the event of a discrepancy between our computer files and the hard copies or electronic documents in your possession, our computer files shall be authoritative.
